On 23rd April, the Court heard WSCUK´s application for:
- a Judicial Review of Her Majesty’s Revenue and Custom's treatment of products originating in Western Sahara being imported into the United Kingdom as Moroccan for the purposes of the EU – Morocco Association Agreement.
- a Judicial Review of the Department for Food and Rural Affairs's granting licences to fish in the territories of Western Sahara under the Fisheries Partnership Agreement between the European Union and Morocco.
Ken Ritchie, one of our members, who attended the hearing, pointed out that: “The court decision was an important first step towards a legal challenge to the UK Government over its disregard of the rights of the Saharawis. The judge dismissed the defence’s assertion that the case had 'little merit' and called for a two-day hearing on whether the cases we brought should be referred to the European Court of Justice. The cases were, he noted, 'of a most unusual kind', but our lawyers remain of the view that we can, and must, win.”
